Options for Debt Relief
We will start with a close look at your finances — how much you owe and the type of debt, your income, assets and expenses. From there, you can trust me for honest answers about bankruptcy and the alternatives:
- Chapter 7 bankruptcy eliminates unsecured debts.
- Chapter 13 bankruptcy repays debts over time and stops foreclosure.
Loan modification — Your mortgage lender or a company specializing in modifications may agree to restructure your loan so that you can save your home. However, it can take overworked lenders months to process your application, only to have the deal fall through. Meanwhile, the lender's enforcement branch may proceed with foreclosure. And every consumer should be aware of the potential for loan modification scams.
I can draft and document a modification request, make sure you are working with a legitimate outfit, and be in position to quickly protect your legal interests if there are problems.
Debt settlement — I can negotiate directly with your creditors to reduce your medical bills, credit card balances, and other consumer debt. These creditors will often agree to more favorable terms with a lawyer acting on your behalf.

Debt consolidation — There are many companies or not-for-profit organizations offering to roll your various debts into one monthly payment. These are not always in your best interests:
- Most are not true consolidation loans that pay off your creditors; the service only acts as a middleman to apportion your payments. Creditors who don't sign on to the program will still harm your credit report, in addition to charging interest and late fees.
- Your overall interest rate will not necessarily be lower, or you may be making "affordable monthly payments" for years and years without paying down the balance and find yourself with the same worries, concerns and problems years from now.
