Alexandria Fair Debt Collection Litigation Attorney

The Fair Debt Collection Practices Act (FDCPA) was added to the Consumer Credit Protection Act in 1978. Under the FDCPA, consumers are protected from the abusive practices of debt collectors. The FDCPA states the laws that debt collectors must adhere to when attempting to collect debts as well as the rights and remedies of consumers who have been victims of creditor harassment.

I am Nathan Baney, an Alexandria fair debt collection litigation lawyer. If you are being harassed by debt collectors, I can determine if you have a valid claim under the FDCPA. You can stop creditor harassment with help from a Reston attorney serving Alexandria, Fairfax, northern Virginia and Washington, D.C.

What Are Debt Collectors Prohibited From Doing?

Debt collectors and creditors are prohibited from engaging in several activities during debt collection communication. These prohibited activities include:

  • Calling consumers between the hours of 8 a.m. and 9 p.m.
  • Calling consumers at work after being informed that it is prohibited by the consumer's employer
  • Contacting consumers after an automatic stay has been issued
  • Contacting consumers after being informed the consumer has an attorney
  • Misrepresenting themselves or the debt
  • Deceiving the consumer
  • Threatening to arrest the consumer
  • Using profanity
  • Using abusive language
  • Revealing debt to third parties
  • Reporting false information on the consumer's credit report

If you are receiving harassing phone calls about a credit card debt, being contacted by creditors after filing bankruptcy or being threatened by debt collectors or if you believe you are a victim of abusive debt collection practices, please talk to me about your rights and options.

What Are My Remedies?

I can represent you in fair debt collection litigation. You can sue the debt collector under the FDCPA. It is important to note that consumers are not responsible for the cost of an attorney in these cases.
